Terms and conditions

Last updated: 1 November 2026

This English text is a translation for convenience. Only the German version is binding and prevails in case of any difference: Allgemeine Geschäftsbedingungen (AGB)

1. Scope and contracting parties

These general terms and conditions apply to every contract for the use of FeedFoundry at feedfoundry.app. The provider is Bernhard Götzendorfer, Rittingergasse 15/11, 1210 Wien, Austria ("we"). The contracting party is the person who creates an account ("you").

These terms apply to businesses and to consumers within the meaning of the Austrian Consumer Protection Act (KSchG). Where a rule applies to only one of the two groups, this is stated. Conflicting terms of yours do not apply, even if we do not object to them expressly.

You accept these terms when you register. If you received your account without this confirmation, you accept them before you create a workspace. Section 11 applies to later versions.

Members. Whoever creates a workspace is its owner and can invite other people (members). Only the owner is the contracting party for the workspace, its subscription and its payment. Actions of members in the workspace count towards us as actions of the owner. For their own account, these terms also apply to members.

Where you process personal data of third parties through FeedFoundry, the following also applies: data processing agreement (DPA). It is part of this contract.

2. Services

FeedFoundry is web-based marketing software (Marketing OS). It runs in the browser; no installation is needed. In the open beta, FeedFoundry comprises:

  • a workspace with your own projects for your products or brands;
  • capturing sources for a project and a Growth Dossier created from them with AI assistance (audience, positioning, claims, voice, topics), which you review, edit and confirm;
  • planning campaigns, including Launch mode;
  • posts for Instagram and Facebook: texts are created with AI assistance, the graphic carrying the text is rendered from fixed templates on our server and is not drawn by an AI;
  • an automatic quality check of every post, a preview, editing of the text, your approval and the export of the checked post so that you publish it yourself;
  • export and deletion of your workspace.

In the open beta, FeedFoundry publishes nothing itself. A direct connection to Instagram and Facebook, scheduled publishing, comment moderation and insights are being prepared and are not part of this contract until we expressly offer them.

The volumes a workspace can use are set out in section 4 (trial) and section 5 (subscription).

3. AI-assisted content and your responsibility

Texts suggested by an AI may be wrong, incomplete or similar to existing texts. The automatic check reduces this risk but does not exclude it. You review every post before you approve and export it. Whether and where you publish a post is your decision alone.

You are responsible for the content you enter and for what you publish. In particular, you make sure that you hold the necessary rights to texts, names, trademarks and logos, that statements about your product are true and that you comply with advertising law and platform rules.

FeedFoundry is software, not legal, tax or advertising advice. We do not promise any particular reach, effect or revenue.

Rights to content. You may use your inputs and the posts created for you without restriction by us. You grant us only the right to store and process your content as far as FeedFoundry requires. We do not use your content to train AI models, and with every request to the AI service we require that it neither stores your content nor uses it for training.

Prohibited use. You do not use FeedFoundry for unlawful or misleading content, to infringe the rights of third parties, for spam or to circumvent limits, cost caps or security measures. In case of a breach we may block the affected content or access. We inform you beforehand unless there is imminent danger.

Your account. You sign in through a link sent to your email address. Keep your mailbox secure and do not share sign-in links. Each person uses their own account. If you notice misuse, write to us immediately.

4. Free trial

A new workspace starts with a free 14-day trial. It covers one project, one Growth Dossier run and five Content Jobs.

A Content Job is one generation-and-check cycle of a post that you start. Text edits to that post and re-rendering do not count separately. Only an explicit "Regenerate" uses another Content Job. A started Content Job counts even if the check fails.

The trial needs no payment method. It ends automatically and does not turn into a paid subscription. Afterwards, AI functions are available again only with a subscription. Your workspace remains exportable and deletable.

5. Subscription, price and payment

5.1 Scope. The subscription costs EUR 29 per month and workspace. It covers one workspace, one active project, two members, 30 Content Jobs and one Growth Dossier run per billing month, and one active Launch campaign. Unused Content Jobs and dossier runs expire at the end of the billing month. To protect against unlimited costs, each workspace has a cost cap for AI calls. Once it is reached, AI functions pause until the next billing month.

5.2 Final price and VAT. EUR 29 per month is the final price. As a small business we charge no VAT. Every invoice carries the notice "Umsatzsteuerbefreit gemäß § 6 Abs. 1 Z 27 UStG 1994" (exempt from VAT under the Austrian small-business rule). If this exemption ends, the price stays at EUR 29 and then includes the statutory VAT.

5.3 Payment. The subscription is billed monthly in advance through the payment service Stripe (Stripe Payments Europe, Limited, Dublin, Ireland). The checkout shows which payment methods are available. Card numbers and bank details are processed by Stripe, not by us. You receive invoices electronically.

5.4 Limited places. The number of paid workspaces is limited in the open beta. Once it is reached, you are put on a waiting list. There is no right to conclude a subscription.

5.5 Payment failure. If a payment fails, AI functions pause until the payment is made. Your data is kept; export and deletion remain possible.

5.6 Price changes. A price increase applies only with your express consent. We notify you by email at least 30 days in advance. Your silence does not count as consent. If you do not consent, your subscription continues at the previous price; we may then terminate it under section 6.2. A price reduction applies from the next billing month.

6. Term and cancellation

6.1 Cancellation by you. The subscription runs for an indefinite period with monthly billing. There is no minimum term and no notice period. You can cancel at any time with effect from the end of the paid billing month, by email to us or, where the app offers it, in your workspace settings under billing. There is no fixed term that renews; your silence never counts as a declaration.

Until the end of the paid month your access stays unchanged. Afterwards we charge nothing more, AI functions pause and your workspace remains exportable and deletable. Months already paid are not refunded pro rata on cancellation. Your right of withdrawal under section 7 and statutory claims remain unaffected.

6.2 Termination by us. We may terminate the contract by email with 30 days' notice. For good cause, such as serious misuse under section 3, we may terminate without notice.

6.3 Discontinuation. If we discontinue FeedFoundry, we announce this by email at least 90 days in advance. Until then, sign-in and export remain possible. Amounts already paid for the time after discontinuation are refunded pro rata.

7. Right of withdrawal for consumers

As a consumer you can withdraw from a paid subscription contract within 14 days without giving reasons (Austrian Distance and Off-Premises Contracts Act, FAGG).

The full information and the model withdrawal form are in the withdrawal information.

Early start. Access to FeedFoundry is a service. If you expressly request that we start before the withdrawal period ends and you then withdraw, you pay a proportionate amount for the time until withdrawal (§ 16 FAGG). We calculate it to the day from the price of the paid month. Your right of withdrawal expires only once the service has been provided in full (§ 18 (1) no. 1 FAGG).

The free trial creates no payment obligation. You can end it at any time by deleting your workspace or writing to us.

Businesses have no statutory right of withdrawal (§ 1 (1) FAGG). If you are unsure whether you act as a consumer or a business, we treat you as a consumer.

8. Availability and further development

We operate FeedFoundry according to the state of the art and aim for continuous availability. We do not promise any particular availability. Maintenance, which we announce in advance where possible, force majeure and disruptions at service providers needed for operation (see annex 1 of the DPA) do not count as outages.

FeedFoundry is in open beta and is being developed continuously. If a feature of the subscription is removed or substantially restricted, we announce this by email at least 30 days in advance. Without notice only where security or a legal requirement demands it.

Statutory warranty rights remain unaffected.

9. Data, export and deletion

How we process personal data relating to your account, sign-in and payment is described in the privacy policy.

For personal data of third parties that you enter into your workspace, you are the controller under data protection law. We process it as a processor under the DPA. If you invite members, you inform them that FeedFoundry logs their changes and approvals in the workspace.

The owner can export the data of their workspace at any time, including after the trial or subscription has ended. The export contains texts and metadata, no image files. The owner can also delete the workspace; deletion is final. As long as the app does not yet offer one of these paths, we handle it on your request by email. We delete your account on request by email.

Keep your own copies of posts you need.

10. Liability

We are liable without limitation for intent and gross negligence and for personal injury.

We are not liable for slight negligence. This does not apply to personal injury, for which we are also liable in cases of slight negligence.

Force majeure. In the event of circumstances beyond our control, such as natural disasters, official orders or the failure of critical infrastructure, the obligations of both parties are suspended for the duration of the event. If it lasts longer than 30 days, either party may end the contract without notice; amounts paid for that period are refunded pro rata.

11. Changes to these terms

We change these terms only for an objective reason, such as new laws, new features or security requirements. We notify you of a change by email at least 30 days in advance and name the main differences. The new version applies to you only if you expressly consent to it. Your silence does not count as consent.

If you do not consent, the previous version continues to apply to you. Either party may then terminate the contract under section 6.

12. Governing law, jurisdiction and dispute resolution

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. If you are a consumer, you keep the protection of the mandatory provisions of the country where you have your habitual residence.

For businesses, the exclusive place of jurisdiction is the court in Vienna having subject-matter jurisdiction. For consumers, the statutory places of jurisdiction apply.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. The EU online dispute resolution platform was discontinued on 20 July 2025.

13. Final provisions

If a provision is invalid, the remaining provisions stay valid. Towards consumers, the statutory rule replaces the invalid provision.

The contract language is German. An English translation is for information only; in case of any difference the German version applies.

We answer questions about these terms at office@gotzendorfer.at.
